JAMMU, Feb 3: Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice BS Walia today set-aside the conviction of 20 years awarded by the trial court in NDPSA case.
After hearing Advocate Rajneesh Oswal appearing for the appellant Ashok Koul whereas Senior AAG SS Nanda appearing for the State, DB observed, “it is a matter of concern that the trial court had erroneously and in a perfunctory manner recorded the conviction”.
“Non application of mind and mis-appreciation of evidence coupled with concoction of facts suggest that unwarranted conviction has been recorded, as a result whereof 20 years rigorous imprisonment has been awarded”, the DB further observed.
With these observations, DB set-aside the judgment and acquitted the accused of the charges.
