10 yrs RI to 2 real brothers in attempt to murder case

JAMMU, Sept 20: Principal Sessions Judge Kathua, Vinod Chatterji Koul today awarded 10 years rigorous imprisonment and fine of Rs 5000 to two real brothers namely Ravi Kumar Raja and Lovely Kumar, sons of Hans Raj, residents of Ward No. 15, Kathua, who were facing trial in attempt to murder case.
According to the police case, on June 26, 2009 these accused persons attempted to kill one Rajan Kumar and during the course of investigation offences punishable under Sections 307/326/323/341/34  RPC and 4/25 Arms Act were established against them. Accordingly, challan was filed in the court of law.
After hearing both the sides, Principal Sessions Judge observed, “the prosecution has established that accused Ravi Kumar and Lovely Kumar have committed offences punishable under Sections 307/341 read with Section 34 RPC and Section 4/25 Arms Act”.
“In view all the facts and circumstances and while balancing the aggravating and the mitigating circumstances, the ends of justice will be met in case both the accused Ravi Kumar and Lovely Kumar are sentenced to undergo rigorous imprisonment for a term of ten years and also to pay fine of Rs 5000 each”, the court said, adding “in case of default in paying the fine, accused shall undergo further imprisonment of six months each”.
