6 yrs imprisonment to accused in attempt to murder case

JAMMU, Nov 29: Principal Sessions Judge Kathua, A K Koul today awarded six years imprisonment and fine of Rs 7,000 to Ravinder Singh alias Tella, who was facing trial in attempt to murder case for the last 10 years and acquitted his brother namely Hari Singh alias Makhnu from the charges.
According to the police case, on October 28, 2003 when Chandu Ram was on his way to home both the accused persons, who had laid an ambush, launched murderous attack on him. In the attack, Chandu Ram sustained severe injuries.
After hearing Public Prosecutor Ravi Gupta for the State whereas Advocate A S Salathia for the accused, Principal Sessions Judge Kathua observed, “Ravinder Singh had the opportunity and the occasion to inflict fatal injuries to the victim which could even cause his death but it appears that he never intended to kill the injured. So in my considered view, the case does not fall within the purview of Section 307 RPC and he is so acquitted of the charge under Section 307 RPC”, adding “it appears that Ravinder Singh has simply committed the offences under Section 325/324 RPC read together with Section 4/25 Arms Act”.
Accordingly, court convicted him and awarded him imprisonment for six years. The Court, however, acquitted Hari Singh of all the charges.
