KPL runs into rough weather, Court issues notices to CS, DYSS

SRINAGAR, May 24: The Kashmir Premier League (KPL) scheduled to be held next month has run into rough weather as Third Additional District Judge, Srinagar has issued notices to Chief Secretary Madhav Lal and various officers of Youth Services and Sports Department following a complaint that KPL trademark has been infringed by Youth Services and Sports Department.
Ghulam Hassan Wani resident of Gulshan Nagar, Nowgam moved an application in the court claiming that he is the real owner of KPL and accused the Youth Services and Sports Department of trade infringement. Wani challenged the holding of cricket tournaments under the banner of KPL by the department saying that his trademark has been infringed.
Wani through the complaint said that the Youth Services and Sports Department has erroneously used his trade mark. He also took a dig at the department demanding a due share of the profits accrued to the Youth Services and Sports department by holding the cricket tournament in the name of KPL.
Acting on the complaint, Third Additional District Judge, Srinagar, Y P Kotwal issued notices to Chief Secretary Madhav Lal, Director Youth Services and Sports, Secretary State Sports Council, Joint Director, Youth Services and Sports and deputy directors of Youth Services and Sports.
“Before passing any effective order in the matter, notice is required to be issued to the non-applicants to provide them reasonable opportunity of showing cause in respect to the relief claimed by the applicant/plaintiff,” said the Judge in his order. He asked the non-applicants to be present in person on May 30 that has been fixed as the next date of hearing.
In his application Wani says that his trade mark is registered with Registrar of Trade Marks of India, New Delhi. He produced the copy of the certificate of Registrar of Trade Marks of India, New Delhi in the court. The certificate has been issued to Wani on February 27, 2012 and the information was given in the local media here.
It would be in place to mention that KPL cricket tournament is going to start in the second week of June.
