Srinagar, Dec 12: High Court directed the Commiss-ioner/Secretary School Education Department to complete the exercise of selection process of class IV posts in district Kulgam as advertised way back in 2014 within four weeks.
The Division Bench of Justice Sanjeev Kumar and Justice Rajnesh Oswal while hearing an appeal filed by the department against the judgment of writ court, directed the Commissioner/Secretary of School Education Department to complete the exercise of selection process of class IV posts in the district within four weeks.
The advertisement notice was issued in the year 2014 by the then Incharge CEO, Kulgam for class IV employees in the department and in response the aggrieved (selected) candidates submitted their application forms for the posts.
The aggrieved (selected) candidates were interviewed by the authorities and were included in the provisional selection list issued by the Selection Committee and after provisional selection they were called upon to submit their testimonials for verification.
After verification the selected candidates submitted their joining reports and were waiting for posting orders, however the CEO Kulgam did not issue posting orders in their favour compelling them to approach the court by way of writ petition.
The authorities came before the court with the contention that the posting orders were not issued because the Committee which conducted the selection process was not validly constituted and the selection carried was in violation of Government order No. 735-GAD of 2008 dated 30.5.2008 wherein the criterion for composition of the District Level Committee for recruitment to class-IV posts in Government departments stood notified.
The writ court allowed the petition of these candidates and declared that the petitioners have been appointed pursuant to selection order against the post in question from the dates they submitted their joining reports.
Writ court also directed the CEO Kulgam to issue orders of posting in favour of the selected candidates forthwith and pay them arrears of salary from the date of submitting their joining reports.
