Legal notice to DC in encroachment case

JAMMU, June 3: Advocate Veenu Gupta today served legal notice to the Deputy Commissioner Jammu seeking implementation of the order dated May 27 passed by the Division Bench of High Court regarding encroachment of a nullah passing through Sharma Resorts to Haji Basti, village Sunjwan.
“The Division Bench had passed order directing maintenance of status quo vis-à-vis the construction being raised by the private respondents—Zakir Hussain and Ashiq Hussain. Moreover, the DB had also directed the district administration to ensure the implementation of the order but illegal construction is still going on to the extent that these persons have now engaged more than 50 labourers to complete the construction in total disregard to the court directions”, the counsel for the petitioners said in legal notice.
“It seems that no effort has been made to ensure implementation of the status quo order with regard to the construction”, Advocate Veenu Gupta said, adding “by virtue of this legal notice you are called upon to implement the order dated May 27, 2013 on spot by restraining the private respondents from raising any sort of construction failing which I have been advised by my clients to file contempt petition before the Division Bench”.
