Purchase of Rs 300 cr property on fake PRC

JAMMU, Oct 28: In a petition filed by ex-MLA Baldev Sharma seeking transfer of investigation and all other proceedings in relation to the FIR registered against Swaran Singh Salaria, who allegedly purchased Rs 300 crore property on fake PRC to Reasi Police to SSP Crime Branch, High Court has directed Investigating Officer to appear in person along with case diary.
In the petition filed through Advocate Ajay Bakshi, it has been submitted that the petitioner had called the status report vide application dated 28-02-2018 in FIR No.4/2011 under Section 467, 468, 471 and 420 RPC on 06-01-2011 at P/S Reasi before the JMIC, Reasi and the SSP Reasi had filed the status report wherein it has been revealed that no step has been taken by the respondents to carry out the further investigation in the FIR and they also failed to file the challan against the accused.
The grievance projected by the petitioner is that an FIR against Swaran Singh Salaria bearing FIR No.4/2011 for commission of offences under Section 467, 468, 471 and 420 RPC was registered in the Police Station Reasi on 06.01.2011. The Police Station Reasi after concluding the investigation submitted a closure report before the court. The petitioner claims that he lodged a protest petition before the court which was accepted and the case was sent back for re-investigation to be conducted by an officer not below the rank of DySP.
He submitted that since then the investigation is pending and is moving at a slow pace. The allegation of the petitioner is that the investigating officer is going slow because of the influence of Swaran Singh Salaria.
After hearing Advocate Ajay Bakshi for the petitioner, Justice Sindhu Sharma observed, “the respondents have filed fresh status report. It is apparent that a letter stands written to the Deputy Commissioner, Jammu for obtaining original PRC issued in favour of the alleged Swaran Salaria as well as the details of the then issuing/verifying authority after investigation of the case would be finalized”.
“This is the third status report filed by the respondents in which the investigation is yet to be completed. Let the Investigating Officer along with the case diary be present in the court on the next date of hearing”, Justice Sindhu Sharma said.
