JAMMU, Jan 9: High Court has restrained the Anti-Corruption Bureau from filing charge-sheet against Rohit Sharma, the then Tehsildar Bahu who was allegedly caught red-handed while accepting bribe.
Senior Advocate Sunil Sethi with Advocate Parimoksh Seth appearing for the petitioner submitted that the petitioner has been wrongly and falsely implicated in criminal case FIR No. 02/2022 registered with Police Station, Anti-Corruption Bureau, Rajouri (camp Jammu) under Section 7 of the Prevention of Corruption Act, 1988.
“The whole drama of trap and subsequent arrest of the petitioner was highly manipulated and in fact nothing of the sort, as has been projected in the trap proceedings or in the FIR had ever taken place”, they said, adding “the CCTV camera footage which is in the public domain clearly indicates that the whole trap was a farce and forged and the trap was laid down to falsely implicate the petitioner”.
Justice Javed Iqbal Wani, after hearing counsels for the petitioner and Senior AAG Monika Kohli for the UT, issued notice to the respondents, returnable within three weeks. Meanwhile, subject to objections and till next date of hearing before the Bench, the investigation in impugned FIR No. 02/2022 dated 14.11.2022 shall proceed however, upon completion of the investigation, in the event charge-sheet is contemplated to be filed, the same shall await the orders of this court. High Court directed.
