Court discharges ex-DHS, others at stage of framing charge

JAMMU, Nov 29: Additional Sessions Judge Anticorruption Jammu Sanjay Parihar today discharged Dr Mohan Parkash Gupta, the then Director Health Services Jammu, Sham Lal, the then SO, Pawan Kumar Bakshi, the then Senior Assistant DHS Jammu and Tarsem Lal and Yash Pal, beneficiaries at the stage of framing charges as the Vigilance Organization failed to prove the charges leveled against them.
While discharging the then Director Health Services Jammu and others, Additional Sessions Judge Anticorruption observed, “in case the Vigilance Organization is interested to pursue the matter further, present order shall not come in their way. Any observation made shall have no effect on such further investigation, if any undertaken”.
“In that eventuality, Vigilance Organization shall be at liberty to obtain record of the case besides all the alleged accused persons shall also render all possible assistance thereto in culmination of such investigation”, the Court said.
According to the Vigilance case, the then Director Health Services abused his official position in a criminal conspiracy with other accused persons and illegally issued regularization order in respect of Tarsem Lal and Yash Pal. Infact, as per record seized from the Health Department Koushaliya Devi and Santosh Kumari were working as part-time safaiwalas in block Bishnah but the accused persons ignored their rightful claim for regularization.
Both the beneficiaries were never existing on the roll of Health Department and nor working as part-time safaiwalas prior to their regularization but despite having been informed about this by Zafar Ali Chib, the then BMO Bishnah no corrective measures were taken by the accused persons.
