THANE, Dec 24: The deficiency in services by the HDFC bank towards a loanee has cost the bank a whooping Rs. 5 lakhs, following an order by the Thane District Consumer Redressal Forum (TDCRF).
President of the Forum Umesh Jhawalikar and member N D Kadam admitting a complaint by one Mr. Eliasparankimam Christopher, of Ambernath in Thane district, has asked the bank’s Ambernath branch to make the payment within a period of 45 days as compensation towards mental and physical sufferings and legal expenses else pay interest at 6% p.a. till realization.
Four branches of the bank including the Retail Assets and Registered office have been absolved of the charges as they are not directly connected with the loaning process, the order said.
The complainant had in his complaint stated that way back in 2007 he had taken a loan towards car purchase to the tune of Rs. 4.59 lakhs and made the payments of the instalments till 2011 after which he wanted to clear the pending loan amount and approached the bank which informed him that if he makes a payment of Rs. 1.16 lakhs the loan account will be closed.
After making the payment of Rs. 1.16 lakhs the bank instead of closing his loan account and returning the original documents credited the loan account to the tune of Rs. 61,895 and the balance of Rs. 54,105 the bank credited to his account.
Later the bank once again started calculating the balance amount of loan and interest on it and also demanded a sum of Rs. 35,048 towards the delayed payment of instalments and cheque return charges.
The complainant further informed the forum that he made the payment of Rs. 35,048 but even then the bank did not close the loan account.
Again the bank credited the sum of Rs. 53,622 to the savings account of the complainant and treated it as excess amount and once again strated the interest on the so called outstanding loan, and kept the loan open.
Consequent upon the failure of the bank to properly calculate the balance amount and credit and close his loan account, the complainant made a claim of Rs. 7 lakh in the complaint with the Forum.
The forum dismissed the submissions of the bank and going by the submissions of the complainant ordered the complainant to make a payment of Rs. 89,194 to the bank which is directed to accept the same and issue an NOC and also return the original documents to the complainant, without further delay and within ten days.
The bank should make a payment of Rs. 5 lakhs to the complainant for the sufferings of the complainant, the forum ordered. (AGENCIES)
