JAMMU, Feb 25: In a Public Interest Litigation (PIL) filed by a social activist Ashok Sharma challenging Rule 17 of Reservations Rules framed under Reservation Act, Division Bench of State High Court comprising Justice Virender Singh and Justice Muzaffar Hussain Attar today directed Chairman BOPEE to appear in person.
After hearing Advocate Kuldeep Singh Parihar for the PIL whereas Senior AAG Gagan Basotra appearing for the State, Division Bench observed, “since nobody appeared on behalf of J&K Board of Professional Entrance Examination let its Chairman to appear in person before this Court on February 26”.
The DB directed Senior AAG Gagan Basotra to take responsibility of informing Chairman BOPEE for his appearance.
According to the petitioner, Rule 17 of Reservation Rules suffers from the vice of arbitrariness as it tends to give much more reservation to the candidate of reserved category than their entitlement.
