JAMMU, May 27: Central Administrative Tribunal (CAT) has held that a Government servant holding a transferrable post has no vested right to remain posted at one place or the other and he/she is liable to be transferred from one place to the other.
This order has been passed by Rajinder Singh Dogra Member (J) Central Administrative Tribunal in a petition filed by Mukhtar Ahmad Mir challenging Government Order No. 280-JK(HE) of 2024 dated 13-05- 2024, along with relieving order 14-05-2024 whereby the applicant has been relieved from his present place of posting—Government Degree College Banihal (Zone C) to GDC Ramban (Zone C).
After hearing both the sides, the CAT observed, “in compliance to the order dated 22.12.2023, the applicant’s case was considered by the respondent-department and thereafter, a reasoned and speaking order was passed by the Principal Secretary, vide Government Order No. 280-JK(HE) of 2024, dated 13.05.2024”.
“Now, through the medium of the present Original Application the impugned order dated 13.05.2024 has been challenged. I have gone through the order passed by the Principal Secretary to the Government and have come to the conclusion that the order has been passed with proper application of mind, thereby considering the case of the applicant”, CAT said, adding “resultantly, the case was rejected by the Competent Authority and moreover, the Government employees are bound to serve anywhere in the State of Jammu & Kashmir”.
“There is no mala fide as alleged by applicant in the present case, nor there is violation of any statutory rule, and the case of the applicant has been considered by the respondent-department, as per provisions of relevant applicable rules and binding instructions on the subject”, the CAT said while dismissing the petition.
