Court keeps Enggs’ placement in abeyance

SRINAGAR, Mar 18:  The Jammu and Kashmir High Court today kept an order of placement of two In-charge Superintending Engineers in Public Works Department (PWD) in abeyance and directed that their signatures shall not be entertained.
A Single Bench of the court comprising Justice Ali Mohammad Magrey after hearing the counsel, Altaf Haqani, for petitioners issued notice to Chief Secretary of the State, Iqbal Khanday and Commissioner Secretary PWD(R&B), Tanveer Jahan.
“In the interest of justice, it is accordingly ordered that the operation of the impugned order (dated 28.2.2014) to the extent it relates to respondents shall remain in abeyance. Consequently, the treasury officers/financial institutions concerned with whom these respondents may have any official financial dealings shall not entertain their signatures as such I/C SEs for operating the finances/funds,” the court directed.
The petitioners have questioned the Government order (no.90-PW(R&B) of 2014 dated 28-2-2014) wherein two In-charge Executive Engineers, Rashid Ahmad Fani and Bashir Ahmad, were promoted as In-charge Superintending Engineers.
Counsel for the petitioners, Advocate Altaf Haqani argued that the official respondents have adopted a policy of ad hocism in the department, and given complete go by to the regular mode of promotions in the Engineering (Gazetted) Service as mandated in CSR 1956.
The court had recently quashed the Incharge arrangements of five SEs and pulled up the department for making ad hoc and stopgap arrangements a norm.
