SRINAGAR, Apr 3: High Court today directed the Vigilance Organization Kashmir (VOK) to register a case against a former Executive/Secretary State Social Welfare Board, Dr Ghulam Mohi-ud-Din, for shifting the Swadhar Shelter Home without any authority and misappropriating funds.
A Division Bench of the High Court comprising Justice Hasnain Masoodi and Justice Dhiraj Singh Thakur directed VOK to register a case against Din under the relevant provisions of JKPC Act 1949 and RPC Code on the basis of inquiry report submitted by it.
Mohi-ud-Din is accused of shifting the Shelter Home from Kralpora, Kupwara, to Chadoora, Budgam, without any authority and misappropriation of funds allotted to run the Home.
While closing the PIL, the Bench directed that an amount of Rs 2.50 lakh diverted by Dr Ghulam Mohi-ud-Din in favour of a woman for purchasing three marlas of land at Chadoora, Budgam, with a sum of Rs 50,000 and Rs 24, 879 by way cheques be deposited with interest rate of 9 percent per annum from the date of their misappropriation till the date of deposit with in a period of 30 days.
The court also directed that the investigation shall be entrusted to a senior officer in VOK and the result of investigation be placed before the competent court in accordance with law, preferably within 3 months.
The Bench after hearing the matter at length observed that the material and record prima facie revealed that the home was shifted by Dr Ghulam Mohi-ud-Din, who at the relevant point was Executive Officer/Secretary SWB, near his home so that he enjoys the facility available to the children from his native place, have the staff recruited from his locality and more so house the said home in a building constructed on a piece of land purchased out of fund allotted by the Ministry of Human Resources Development, Department of Women and Child Development, GoI.
The Court also directed Ministry of Human Resources Development, Department of Women and Child Development, GoI, to continue release of funds in favour of Secretary SWB/Deputy Commissioner, Kupwara, to facilitate smooth running of Swadhar Shelter Home in Kupwara in accordance with rules in receipt of utilization certificates required.
