JAMMU, May 8: High Court today directed the Jammu University to permit the petitioners, who were rusticated and whose entry was banned in the varsity campus following clash between two groups of students, to take part in the examinations.
The direction was passed in a petition filed by Cathleen Kour and others challenging the decision of the Jammu University on the ground that the order impugned was passed without affording any opportunity of being heard and there was no material on the basis of which such decision was taken by the varsity authorities.
After hearing the petitioners in person, Justice Ali Mohammad Magrey directed University authorities to permit the petitioners to take part in the examinations. “The deficiency in attendance on account of their ban/rustication or suspension shall not be counted towards their qualification for appearance in examination”, High Court said.
The High Court further directed that the petitioners shall take their examinations, which shall be subject to outcome of the present petition and the result of the examinations in regard to the petitioners shall not be declared till further orders.
