JAMMU, May 19: In a petition filed by the then District and Sessions Judge Brij Mohan Gupta challenging his compulsory retirement, Justice Tashi Rabstan today issued notice to State through Secretary Law, Justice and Parliamentary Affairs and Registrar General of High Court returnable within two weeks.
In the petition, it has been submitted that the Government order declaring the compulsory retirement of the petitioner was totally illegal and against the provisions of law. The petitioner prayed for directions to the respondents to allow the petitioner to complete the service up to 60 years and also grant all consequential benefits in his favour.
Senior Advocate Sunil Sethi with Advocate Vaibhav Gupta was appearing for the petitioner. Justice Tashi Rabstan, while issuing notice to the State through Secretary, Law, Justice and Parliamentary Affairs, directed Registry to list the petition immediately after completion of service.
