DB’s directive on organ transplant centre

JAMMU, May 20: Division Bench of High Court comprising Justice Mohammad Yaqoob Mir and Justice Dhiraj Singh Thakur today issued directions in a Public Interest Litigation regarding establishment of center for transplant of organs in hospitals.
When the PIL filed by Smile Social Youth Club through its President Matloob Saleem Qureshi came up for hearing, Division Bench observed, “in compliance to order dated October 29, 2013, an affidavit has been filed by Commissioner Secretary to Government, Health and Medical Education Department admitting that facilities for transplantation of human organ are not available in the Government Medical Colleges”.
“It has been stated in the affidavit that permission was granted to start kidney transplant facilities (Urology Division) in the two Medical Colleges but that could not be started due to non-availability of funds and necessary infrastructure”, the DB said, adding “as per the affidavit the matter was again taken up with the Principals of GMCs to furnish detailed proposals regarding establishment of different organ transplant facilities with funds required for the purpose vide communication No. ME/Legal/Genrl./2013/47-S dated 05.03.2013”.
“Both the Principals were asked to furnish the proposals within two weeks positively and accordingly an application was filed by the Commissioner/ Secretary Health and Medical Education before this Court to grant six weeks time to file status report in the matter. However, the response is awaited”, the DB said.
Accordingly, the DB directed Principals of both the Colleges to ensure that detailed project report/proposal is submitted to Commissioner Secretary Health & Medical Education within shortest time preferably within four weeks and Commissioner Secretary was directed to monitor the same well within time.
During the course of arguments, counsel for the PIL highlighted that the faculty position in Medical Colleges was not up to mark and the patients were suffering badly. Upon this, Division Bench directed Advocate Naveent Dubey to file a detailed application in this behalf.
