Court frames charges in forgery, cheating case

JAMMU, May 21: Principal Sessions Judge Jammu, R S Jain today framed charges against Mohd Kais in cheating and forgery of Rs 65 lakh.
According to the prosecution case, the complainant Sheikh Mujeeb was in the possession of land measuring 16 kanals in Survey No. 54, 55, 56 and 41 situated in village Sunjwan and he took possession of the land from one Mangta. Later, Mangta along with some persons started interfering with the possession of the complainant following which a civil suit was filed in the court of 2nd Additional Munsiff, Jammu wherein parties were directed to maintain status quo on spot.
Thereafter accused Mohd Kais along with other persons trespassed into the land of the complainant and later on the direction of Sub Judge, Jammu, an FIR was lodged in Police Station Trikuta Nagar. Later, the complainant and the accused persons entered into a compromise whereupon the complainant agreed to sell the land to accused Mohd Kais for Rs 75 lakh and an agreement to sell was attested before the public notary.
Rs 10 lakh was given as advance and the balance of Rs 65 lakh was to be paid to the complainant by the accused before 31.3.2010. The accused produced two receipts amounting to Rs 35 lakh and Rs 11 lakh before Incharge Police Station Trikuta Nagar, Jammu.
However, the complainant told the police that he has neither received any amount from the accused and nor has he signed the receipts produced by the accused. Hence, the accused has prepared false documents and action under law be taken. On receipt of the complainant, FIR No 53/12 for offence under Section 420/467/468/471 RPC was registered in Police Station Bahu Fort against accused Mohd Kais.
During investigation, it was established that Mohd Kais had prepared the forged documents in the shape of receipt for Rs 35 lakh and Rs 11 lakh in the name of complainant.
After hearing both the sides, Principal Sessions Judge observed that a prima facie offence under Section 420/ 467/ 468/ 471 RPC was made out against accused and accordingly accused Mohd Kais was charge sheeted for the offences.
