Court rejects closure report, directs further investigation

JAMMU, Aug 9: Additional Sessions Judge Anticorruption Jammu, Sanjay Parihar today rejected the closure report filed by the State Vigilance Organization in a Disproportionate Assets case against Junior Engineer of Public Works Department and issued directions for further investigation into the case.
JE Ashwani Kumar, who was then posted in M&RE Division Poonch was arrested on September 20, 2006 for indulging in corrupt practices. During the course of preliminary inquiry, it came to fore that he has acquired assets like land and house in Poonch town, a two storey luxurious house on plot measuring 40/80 in Sector 5 Trikuta Nagar and a plot of land measuring 40/80 in Sector 5 Trikuta Nagar adjacent to the house, a three storey hotel under the name Pine View on a piece of land measuring 3 kanals and 14 marlas acquired in the name of his wife at Kud besides other investments.
However, after completion of investigation, Vigilance Organization filed closure report in the Court.
After going through final report submitted by Vigilance, Additional Sessions Judge Anticorruption Jammu observed, “court has failed to understand as to why the investigating officer has not dealt with all the aspects and has proceeded to close the case as not admitted which in my view is summary closure of investigation and this act on his part is highly deplorable”.
“Investigation into the conduct of the official has been going for the last 8 years and the pendulum of investigation has been swinging from one to another without yielding any fruitful result”, the court said, adding “even supervisory officers have been found lacking in discharge of their duties of the fair investigation which they owe not only to themselves but also to the public at large”.
“I am pained in observing that the investigation has been closed as not admitted at the behest of Central Office of Vigilance Organization, a premier agency having exclusive control of Vigilance Organization”, Additional Sessions Judge said
With these observations, Court disallowed the final report/closure report and directed Vigilance Organization to make further investigation of the case and take the case to its logical conclusion.
