LeT Comdr acquitted in murder case due to prosecution failure

JAMMU, Aug 13: Principal Sessions Judge Poonch, Jaffer Hussain Beigh today acquitted alleged commando of Lashkar-e-Toiba (LeT) namely Mohd Taj, son of Mohd Yousaf of Marrah of Surankote, who was facing the charges of murder as prosecution failed to prove the case.
According to the police case, on May 28, 2004 the accused affiliated with militants organization Lashkar-e-Toiba as its Commando along with other militants killed Dost Mohd over an old enmity.
After hearing both the sides, Principal Sessions Judge observed that prosecution has examined nine witnesses out of a list of 14 witnesses, who in one voice stated that they were not on spot at the time of the occurrence.
“All the prosecution witnesses except doctor (who conducted the post-mortem) were declared hostile as they have not supported the prosecution case at all and the prosecution was allowed to cross-examine them but nothing incriminating was elicited from their statements when cross-examined”, the court said, adding “there is no incriminating circumstance to be put to the accused under Section 342 CrPC. There is not an iota of evidence against the accused with which he has been charged”.
Accordingly, court dismissed the challan and acquitted the accused.
