BAJ’s appeal to Distt Bars on Tenancy Act

JAMMU, July 18: Acting on the resolution passed by the Executive Committee, the Bar Association Jammu (BAJ) today appealed the Bar Associations of all the districts and Muffasils in Jammu province to attend an emergent meeting on July 20 to discuss the propriety and constitutionality of the Jammu and Kashmir (Residential and Commercial) Tenancy Act, 2012.
The representatives of the Bar Associations across Jammu province have been requested to render their opinion towards taking appropriate remedial steps aimed at protecting the common citizens from the serious repercussions of the enactment of the Act.
It is worthwhile to mention that Bar Association has already decided to abstain from work in all the courts for two days— July 20 and 21 against J&K (Residential and Commercial) Tenancy Act, 2012.
“The legal fraternity across State has been protesting against the legislation by which the State Government is divesting the Civil Courts of their powers to judiciously adjudicate the disputes arising between landlords and tenants and vest them with the Assistant Commissioners and Tehsildars across the State”, general secretary of the Bar said, adding “settling the intricate disputes between the landlords and tenants involve interpretation of different laws and acts and since these officers lack legal expertise the problems of the already suffering litigant public would only aggravate”.
The meeting of the representatives of Bar Associations of Jammu province is being convened to further discuss the mode to oppose move of the State Government in divesting powers of Presiding Officers of Motor Accidents Claim Tribunal in short (MACT) and Traffic Magistrate from adjudicating the disputes relating to claim/challans and vesting the same to the bureaucrats.
