JAMMU, Sept 2: Division Bench of State High Court comprising First Puisne Judge Justice Virender Singh and Justice Tashi Rabstan today disposed of a Letters Patent Appeal filed by Zubeeda Bano by modifying the order of the Single Judge whereby the writ court had stayed the operation of Government Order No.590-Edu of 2014 dated 22-08-2014 whereby Zubeeda Bano on promotion had been adjusted as ZEO, Ramban vice Om Parkash, who was posted as Incharge ZEO Gool.
While modifying the order of the Single Judge dated August 25, Division Bench observed, “at the very outset it has been brought to our notice by Senior Advocate P N Raina with Advocate Irfaan Khan appearing for Zubeeda Bano that pursuant to Government Order No.590-Edu of 2014 dated 22-
08-2014 the appellant (Zubeeda Bano) had already joined at new place of posting (Incharge ZEO, Ramban) before the order got stayed directing that the respondent/writ petitioner (Om Parkash) shall be permitted to continue as Incharge ZEO Ramban till further orders.
After hearing Advocate G S Thakur appearing for the respondent Om Parkash, who denied the joining of Zubeeda Bano, the Division Bench modified the order of the Single Judge and directed that the impugned Government Order No.590-Edu of 2014 dated 22-08-2014 in so far as it relates to the writ petitioner (Om Parkash) shall remain stayed in case private respondent (Zubeeda Bano) has not joined pursuant to the aforesaid impugned order.
With these observations/modifications, the DB disposed of the LPA.
