JAMMU, May 5: In the much publicized PIL regarding inaction on the part of the State in implementing Jammu and Kashmir Water Resources (Regulation and Management) Act, Division Bench of State High Court comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal today took serious note of non-filing of reply by the State.
When the matter came up for hearing, Division Bench observed, “despite adequate and reasonable opportunity State has not filed any reply”. On this, Senior AAG SS Nanda appearing for the State sought time. Conceding his request, Division Bench granted four weeks last and final opportunity for filing reply.
In this PIL, the Division Bench had earlier stayed the sale and construction in the areas of water body and sale of land concerning the bed of the river and the land which has been recorded as Khad in the revenue records.
