Srinagar, Aug 3: In a major relief to the Jammu and Kashmir Cricket Association (JKCA) faction led by former Chief Minister Farooq Abdullah, the trial court in Srinagar today directed not to oust the former elected office bearers of JKCA from their post for which they have been elected in the year 2014 till next date of hearing.
The trial court after hearing the arguments of plaintiff counsel advocate Javed Iqbal with advocate Sajad Ahmad Sofi found that the case for interim relief is made out and issued notice to the other side (defendants) and directed not to oust the plaintiff association from their post till next date of hearing in the matter on August 8 without following due course of law.
“Keeping in view urgency pleaded by the learned counsel for the plaintiff issuance of prior notice to the defendants 1 to 6 for service and objections. Subject to the objections defendants shall not oust the elected members and office bearers from their post for which they have been elected on 12.5.2014 without following the due course of law till next date of hearing. Let the file for appearance and written statement as well as objections on 8.8.15”, directed the court of 1st Additional District Judge Srinagar presided by Madan Lal
The suit has been filed against Imran Raza Ansari, Mehboob Iqbal, Iqbal Shah, Abdul Rouf, Javed Ahamd Kitab, Mohammad Ashraf, Rakesh Kumar and Sudershan Mehta by JKCA’s General Secretary M L Nehru .
It is pleaded in the suit that elections held on 12.5.2014 wherein 64 participated and Dr. Farooq Abdullah was elected as President of the Association unanimously with other members. Those elections were held under the supervision of Abdul Wahid( Retired Disrict Judge) as an observer appointed by the court to oversee the proceeding of the elections.
The dispute arose when the Ansari faction held elections of the Association in the month of July 2015 and those election were challenged before the trial in Jammu and the recently elections were stayed.
The Abdullah faction recently filed complaint before the court of CJM and it was transferred to the 3rd Additional Magistrate Srinagar wherein SHO concern has been directed to investigate the trespassing the Association office and file status of the investigation before the court.
Advocate Javed Iqbal with Advocate Sajad Ahmad Sofi appearing counsels on behalf of Plaintiff (Nehru) pleaded before the court that in case interim relief asked is not granted and only notice issued to the defendants would make the whole suit infructuous.
“Learned counsels for the plaintiff has argued that in case issuance of notice to the otherside for effecting the service will take considerable time and in case the relief sought is not granted, the suit would become infructuous”, reads the order of trial court.
