JAMMU, Oct 9: CJM Reasi Kamlesh Pandita today rejected the bail application of one Ali Akbar, son of Abdul Hamid of Rajouri, who was alleged involved in kidnapping of minor.
After hearing CPO Reasi DP Singh appearing for the State, CJM observed, “medical report is awaited. The law for bail is settled that the accused is considered to be innocent unless circumstances warrant in negative and is of conscious that the liberty of the individual is a precious right guaranteed to him in the constitution”, adding “at the same time, such right requires to be curtailed, if the offence is against the public order or public conscience”.
“The offence alleged to have been committed by the accused person is heinous, as has been committed on a minor girl which offence is considered to be not only against the person of the individual but against the public at large”, the court said, adding “such offences being committed day in and day out by the criminals, deserve to be deplored”.
With these observations, court rejected the bail application.
