HC directs Govt to confirm nationality of woman for deportation

SRINAGAR, Apr 29: Jammu and Kashmir High Court today directed the Government to confirm the nationality of a foreigner lady and take steps for her deportation along with her minor child.
After providing the particulars of the petitioner Rubeena by her counsel who is lodged in Central Jail Kot Bhalwal with her minor child, Justice Ali Mohammad Magrey today said it would not be difficult for the respondents to confirm the nationality of the petitioner with Pakistan High Commission and “in making arrangements for her deportation along with her minor child to her native country”, Justice Magrey added.
Petitioner Rubeena was arrested in November 2012 along with her minor child in Kanachack Jammu and was booked under commission of offence punishable under Foreigners Act. She was after conviction and sentence provided with consular access with officials of Pakistan High Commission, however, her nationality has not been confirmed by the Commission
It has been stated that MHA is constantly pursuing the matter regarding the confirmation of nationality of petitioner through MEA and as soon as her nationality is confirmed and travel documents issued, she will be repatriated to Pakistan.
“Perusal of record reveals that it is only for want of full particulars about the petitioner that the case is stuck for final decision” court said and held that it is responsibility of the State Government to seek full details of the petitioner and to ensure deportation of her along with her minor child as court directed on May 2014.
Court further said that the respondent-state has left it to the petitioner who is a lady without any human support and it is the counsel who has come forward to help the lady. “There should be no difficulty for the State respondents to ascertain the full particulars with reference to nationality of the petitioner”, Court said and sought response from the authorities in this regard with three weeks.
