HC directs Govt for 25% reservation in pvt schools for underprivileged

Srinagar, May 17: The High Court today directed the Government to frame policy for reservation of 25 percent admissions for students of underprivileged class in private schools under Right to Education Act.
Disposing of a related Public Interest Litigation, a Division Bench of High Court directed the Government to take decision within two months on the representation submitted by the petitioner seeking framing of policy for reservation of 25 percent admissions for students of underprivilege class in private schools under Right to Education Act.
The bench headed by Chief Justice N Paul Vasanthakumar also directed the Government to take decision on formulation of a comprehensive education policy for the State.
“Since the representation is pending before the Government from 3-9-2015, we are of the view that at the first instance the matter may be directed to be considered by the Government as prayed for the petitioner in the representation,” the bench observed.
The directions came following the submission by the petitioner through his counsel that before filing the PIL, he submitted a representation to Chief Secretary asking the Government to make a policy for reservation of 25 percent quota for students of underprivileged class of the society in all private schools of the State.
In the representation made by the petitioner in keeping with the Supreme Court judgment in case titled Society for Unaided Private Schools of Rajasthan versus Union of India & another, the Government was also asked to make a comprehensive education policy for the State.
Direction is also being sought by the petitioner that status in respect of leased land currently under possession of the private schools be filed before the court along with the tenure of lease to these institutions.
Petitioner prayed that a direction be issued to the school authorities to disclose the list of beneficiaries of the students of lower class who have got benefitted to the ‘underprivileged’ class of the society without payment of any fees since these schools were established.
It is further contended that authorities be directed to disclose the list of all the private schools getting the grants and funds from the State and the amount of grant and funding issued in their favour.
