HC suspends conviction of Patwari, grants bail

JAMMU, Sept 20: High Court has suspended conviction of Harbans Lal, the then Patwari, who was awarded two years imprisonment by the Special Judge Anticorruption Court in a trap case.
After hearing Senior Advocate Sunil Sethi for the petitioner whereas Deputy AG for the State, Justice Tashi Rabstan observed, “in view of the gravity of offence, the manner and method, also keeping in view the submission made and the law laid down by the Apex Court and the position of less chances of the hearing of the appeal in near future, exercise of discretion in favour of accused at this stage is warranted so as to advance the object of Article 21 of the Constitution of India”.
“Pending appeal, execution of sentence is suspended. Accused-applicant is directed to be released on furnishing bail bond to the tune of Rs 50,000 to the satisfaction of Registrar Judicial and personal bond of the like amount to the satisfaction of Superintendent Jail concerned with a condition that he shall ensure his presence before this court on each and every date of hearing”, Justice Rabstan directed.
