SRINAGAR, Oct 14: High Court has directed the Government to send the Annual Progress Report (APR) of Dr. Javed Choudhry, who makes claim for the post of Principal GMC Srinagar, to Central Government for assessing and verifying the same.
The direction to the Government has followed after State Health and Medical Education Department submits that the APR of Dr. Choudhry for the year 2012-13 has been missed out at the time of review.
The court directed the Health and Medical Education Department to send the APR of Dr Choudhry through some special messenger to Joint Secretary, Ministry of Commerce and Industries, Government of India so that the post in question be filled on substantive basis.
“In order to accelerate the process of making appointment on the post of Principal on substantive post the Secretary to Government Health and Medical Education Department shall sent the APR of Dr. Choudhry for the year 2012-13 through some special messenger to Joint Secretary”, directed the Division Bench of Justice MH Attar and Justice Ali Mohammad Magrey.
Court also said that the necessary documents shall be sent to Joint Secretary, Ministry of Commerce and Industries Government of India within a period of three days and for this purpose State Government can utilize the service of Commissioner Secretary H&ME for doing the needful.
Court also directed the Joint Secretary, Ministry of Commerce and Industries Government of India M K Dwivedi to return the documents complete in all respects within three days thereafter and posted the matter for further consideration in the week commencing from October 24.
Meanwhile, court has sought compliance report from the State Government about the implementation of DB judgment. Court in its judgment passed in the month of March this year had directed the State Government to fill up the post of Principal GMC, Srinagar within eight weeks from today (i.e March 3) on regular basis in accordance with the rules.
