Srinagar, June 13: High Court has directed the authorities for making the new district court complex functional by ending June and sought information about the regularization of daily wagers of the judiciary before the next date of hearing.
State counsel produced a communication issued by Department of Law, Justice and Parliamentary Affairs along with a statement of physical and financial status of works under execution on court complex in Kashmir Division.
Court on perusal of the statement said that there is no date of completion of the projects. “We find that no expected dates of completion have been given for the projects which are yet to be completed”, Division Bench of Chief Justice Badar Durez Ahmad and Justice Sanjeev Kumar said.
The statement of LJ&PA reveals that only one project (Lawyers Chambers at High Court complex) has been completed and that was already done two years ago. It is further stated that construction of Lawyers Chamber in new district court complex is complete, however, the same cannot be utilized unless the whole court complex is completed and made functional.
Court while observing that there is dire need of its completion at the earliest, directed the State to ensure that the court complex is completed in all respects by the end of June this year for making it operational.
Issue of daily wagers in judiciary was also discussed during proceedings of the matter and about the issue of additional staff, the Registry of High Court has submitted the updated proposal in this regard. Court directed the respondents to respond to the proposal immediately as also the issue of daily wagers of judiciary be also spelt out before the next date of hearing.
In the first instance Court sought affidavit from the authorities indicating therein as to what steps have been taken for regularization of daily wagers working in High Court as also in subordinate courts.
Court previously made the observation to the State counsel that only its order has been set aside by the Supreme Court but the matter is open for this court in light of Supreme Court observations, adding why not posts are created for daily wagers and these are absorbed when there is dearth of staff in this court as well as subordinate courts. It may be mentioned here that Supreme Court in SLP filed by the Government against DB order observed that Government is responsible for creating situation of recruiting persons on daily wage basis on large scale.
