PoK under forcible occupation of Pakistan, also part of India: KPC

JAMMU, Oct 5: Kashmiri Pandit Conference (KPC) lambasted Kashmir Bar Association for  terming the accession of the J&K State with India as  mysterious and controversial.
While strongly advocating that J&K is legally and undoubtedly the integral part of India and non-negotiable, Kundan Kashmiri, president KPC in a meeting of his organization at New Delhi today reiterated that it was not India which defied and denied so—called plebiscite to people of Kashmir, but Pakistan which in fact did not  accept and acted  on the United Nations Security Council (UNSC) Resolution 47 of April 21, 1948 that asked India to appoint a plebiscite administrator nominated by the United Nations who would conduct a free and impartial plebiscite after Pakistan withdraws all its fighting forces from the Jammu & Kashmir territory forcibly occupied by it.
He further said that it was Sheikh Mohd. Abdullah, who was finally part of accession to declare J&K integral part of India. It was also with the consent and desire of Sheikh Abdullah in  1951, when Dr. Karan Singh announced democratic elections based on universal franchise across the entire State for the formation of a Constituent Assembly to enact a full-fledged Constitution for Jammu & Kashmir State separate from the Constitution of India framed in 1950, he added.
He said it was this Constituent Assembly that enacted, on November 07, 1956, the State Constitution in which Section 3 stated that “the State of Jammu and Kashmir is and shall be an integral part of the Union of India”. What was more, that Section was made constitutionally non-amendable.
Kundan Kashmiri further stated that it is Pakistan-Occupied-Jammu & Kashmir which is actually disputed territory and not the J&K State as  PoK was taken by Pakistan through aggression, not by consent or under any agreement. So, under these circumstances, the so—called plebiscite demand or any other demand which can take the State of J&K away from India, cannot be accepted to any one on factual terms.
Besides, Kashmiri masses are availing all concessions, liberties and privileges, which they would have never got from any other quarters, therefore they should not get misled by Pak and its agents .
KPC reiterated its demand that Government at the helm of affairs at the Center should send final and tough message to Pakistan and separatists that no talks can be held on  Kashmir and India is committed to Parliament resolution of 1994 which has resolved that India will liberate PoK from the clutches of Pakistan.
