Without enquiry arrest of accused doctors illegal: DAJ

JAMMU, June 1: Doctors Association Jammu (DAJ) today termed as illegal the arrest/custody of Dr Satish Mehta (ENT surgeon) and his team including Anesthetists and paramedical staff after a woman they were operating on May 31 at Dr Satish Mehta Clinic died due to some alleged medical complications.
In a press release issued here, DAJ president, Balvinder Singh said according to Supreme Court (SC) guidelines, police can arrest a doctor only if he or she is found guilty in enquiry conducted by a team of expert doctors.
However, he regretted that in J&K, no such rule is being followed and harassment of doctors as well as paramedical staff by the police continues in the State. He said that arrest of Dr Satish Mehta and his team in yesterday’s incident is a testimony of this.
He said there is always surgical and anesthesia complications during surgery, which is explained to the attendants of the patient prior to the surgery. “If during anesthesia, a patient dies with drug reaction how can doctors and paramedical staff be held guilty”, he added.
Meanwhile, Dr Nandita, Anesthetist and wife of Dr Satish Mehta, while clarifying on the death of woman said that patient was scheduled for tonsillectomy on May 31. She said, “when the patient was being prepared for the surgery, she was given drug in the operation theatre after which she developed Bronchospasm”.
She said that patient was intubated and air entry in both the lungs was checked but despite providing all treatment and drugs for spasm, her oxygen saturation could not be maintained. “Other fellow doctors were also called for help, who joined the team but then the patient had a cardiac arrest and despite doing immediate defibrillation and CPR, she could not be revived”, Dr Nandita added.
The DAJ president appealed Director General of Police, SP Vaid, to intervene into the matter, follow the Supreme Court guidelines and took action against the police officer, who without following proper procedure (as per SC) arrested Dr Satish Mehta and his team.
