DB directives in petition regarding dearth of staff in J&K courts

JAMMU, Aug 1: In a petition filed by Joginder Singh, Bench Secretary of the High Court regarding dearth of staff at various level, pay anomaly in respect of officers and staff and promotional avenues to Law Graduate Readers of the High Court, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Sanjay Kumar Gupta today issued certain directions to the Government.
After hearing both the sides, DB observed, “on 27.02.2018 and 01.06.2018, respondents had been directed to file the separate affidavits, indicating therein as to what steps had been taken with regard to 09 agenda items, which were discussed in the meeting held on 20.03.2018, convened in the office chamber of the Registrar General of  the High Court”.
“The progress shown with regard to the agenda Nos. 1 to 8 is satisfactory. However, with regard to the agenda item No. 9, the view adopted by the Government related to the issue of removal of pay anomaly by the Pay Anomaly Committee is erroneous”, DB observed, adding “it was urged that the issue was not so much with regard to the removal of pay anomaly between the J&K High Court Staff inter se, as much as it was pertaining to bringing the staff at par with the staff of other High Courts like Delhi and Punjab & Haryana High Court”.
DB said, “let an appropriate decision be taken by the Government in terms of communication dated 28.12.2017 read with communication dated 21.07.2018 and the result thereof be conveyed to this office positively on or before the next date of hearing”. DB also directed respondents to submit a detailed status report with regard to the further action taken with regard to agenda item Nos. 1 to 8 on the next date.
