Court denies bail to man involved in unlawful activities

JAMMU, Mar 1: Special Mobile Electricity Magistrate Pattan Amarjeet Singh Langeh today rejected the bail application of Jameel Ahmad Bhat, son of Ghulam Mohiudin Bhat of Baramulla, who was allegedly involved in unlawful activities.
“The petitioner is involved in commission of offences under Sections 120-B, 505(1)(B) of RPC and Section 10 of Unlawful Activities (Prevention) Act which are heinous as such petitioner is not entitled to concession of bail”, the court said, adding “investigation is at initial stage and if admitted to bail, the ongoing investigation would be hampered”.
“It is, also submitted that this court lacks jurisdiction to entertain bail application for offence pertaining to Unlawful Activities (Prevention) Act because the entire Act has been placed in the schedule of National Investigation Agency Act 2008 and therefore the offences under this Act are to be tried and bail pertaining to those is to be entertained by the Special Court only”, Special Mobile Electricity Magistrate said.
Accordingly, the bail application was rejected.
