Court acquits accused involved in woman’s death

JAMMU, Mar 26: Principal Sessions Judge Kathua, M K Hanjura today acquitted three persons including husband of a woman, who had committed suicide following harassment at the hands of accused persons, as the prosecution failed to establish its case.
According to the police case, on January 14, 2008 dead body of one Subhadra Devi, wife of Ashok Kumar of village Sananght, tehsil Basohli was found hanging on a tree in the village. Accordingly, proceedings under Section 174 CrPC were initiated in the case.
During the course of investigation, it came to fore that one Rattan Chand, son of Chetu living in the vicinity of the deceased had decided to marry a woman living at the parental village of the deceased.  He inquired about her character and antecedents from the deceased, who told him that she was a woman of easy virtue.
When Ashok Kumar, husband of the deceased came to know about such utterances having been made by the deceased he beat her mercilessly. Due to the fear of being beaten up again by her husband and his brother Darshan Kumar besides Rattan Chand, who had warned to strip her before the members of local Panchayat, she hanged herself to death.
After hearing Advocate A Slathia appearing for the accused persons whereas Public Prosecutor Ravi Kumar Gupta for the State, Principal Sessions Judge Kathua observed, “the cumulative effect is that the prosecution has failed to connect the accused with the commission of the crime.  The nexus between the death of the deceased and the alleged acts of the accused has not been proved”, adding “even if it is assumed that the utterances attributed to have been made by the accused were actually made by them,   the deceased had no reason to put an end to her life.  She had enough time to think over”.
“A judicial process which can only be issued on the firm foundations of credible evidence cannot be issued in the instant case.  Prosecution has failed to connect the accused with the commission of crime”, the Court said while acquitting the accused of the charges.
