Srinagar, May 26: High Court has sought response from the police to the plea filed by journalist Gowhar Nazir Geelani for transferring the investigation of FIR from Cyber Police to J&K Police, registered against him under the offence of Unlawful Activities Act.
Justice Ali Mohammad Magrey issued notice and sought response from the Police by or before May 28. The notice issued, however, was by counsel appearing on behalf of the Home Department. He has been directed to file his objections by next date of hearing in the matter with a copy of objection in advance to Geelani’s counsel.
Geelani’s petition seeking quashing of FIR is already pending before the court and during the pendency of the case the investigation of FIR has been transferred to Police station Sadder Srinagar on April 22.
Questioning the transfer of investigation of FIR, he has filed a separate petition through his counsel Soleh Peerzada on various grounds. Advocate Peerzada while highlighting the grievance and apprehension regarding the arrest of the petitioner invited the attention of the court to the objections filed by the police in his previous petition.
Court, however, has not taken any view on these submissions and said that it is for the respondents to deal with the issue. The further hearing of both the petitions has been fixed for May 28.
Geelani submits that the contents of FIR furnished details regarding the alleged commission of offence by him do not disclose the cognizable offence which is the basis for registration of case by the Cyber Police Station.
