Adhoc committee can’t be restrained from carrying out fencing activity: Court

JAMMU, Jan 18: 1st Additional District Judge Jammu, Virinder Singh Bhou has directed that the adhoc committee cannot be restrained from carrying out the fencing activity in the Union Territory of Jammu and Kashmir.
This judgment has been delivered in case titled Jammu and Kashmir Amateur Fencing Association (JKAFA) versus Fencing Association of India (FAI).
“Keeping in view the facts and circumstances of the case, no prima-facie case for confirmation of interim injunction dated 13.10.2023 is made by the Plaintiff Association (JKAFA), because the issues raised revolve around the legality or otherwise of the election conducted on 06.05.2023 and constitution of the Plaintiff Association and also the registration of Plaintiff Association with the defendant”, the court said.
“Till these issues are not settled, the adhoc committee which is valid till 31.03.2024 cannot be restrained from carrying out the fencing activity in the UT of Jammu and Kashmir because the future and career of the players cannot be jeopardized”, the court ordered.
The court also vacated interim injunction dated 13.10.2023.
