Bail in anticipation of arrest denied to Sr Asst

JAMMU, Sept 29: Special Judge Anti-Corruption Jammu Y P Bourney has denied bail in anticipation of arrest to Senior Assistant in the Health and Medical Education Department, who was booked by the Anti-Corruption Bureau for demanding and accepting illegal gratification from a doctor for processing his case for early reinstatement.
As per the Anti-Corruption Bureau case, a preliminary verification was conducted into the allegations in the written complaint lodged by Dr B R Kundal, Associate Professor GMC Jammu (the then HoD Neurology, Super Specialty Hospital) with the Chief Secretary which was duly forwarded by the General Administration Department to the Director of Anti-Corruption Bureau for necessary action under law.
Upon finding substance, a formal case was registered for the commission of offences punishable under Prevention of Corruption Act. During investigation it came to the fore that accused had demanded and accepted Rs 25,000 as illegal gratification for early reinstatement into service of the complainant, who was already under suspension and was facing departmental enquiry pursuant to the registration of FIR under Section 354 RPC at Police Station Bakshi Nagar Jammu.
After hearing both the sides, the Special Judge Anti-Corruption observed, “it is clear from the report that accused had tried his best to outsmart the law enforcing agencies by providing the account number of his friend for depositing the bribe money”, adding “further accused is alleged to have threatened and forced his friend to deposit the money back to the account of complainant during the course of inquiry”.
“It is also reported that the accused visited the clinic of the complainant a number of times and threatened him to withdraw the complaint. The accusations against the accused are well founded and well substantiated”, the court said, adding “the attempts of the accused in threatening the complainant and witness in a bid to force them to resolve from the accusations as well as routing back the bribe money are sufficient to reflect that it would be dangerous to arm the applicant with a pre-arrest bail order at this stage”.
With these observations, court denied bail in anticipation of arrest to the accused.
