CB books 6 persons for cheating, preparing fake documents

JAMMU, Nov 16: Crime Branch (CB) Jammu has registered a case against six persons for cheating and preparing fake and fabricated documents of land. They included Mahinder Pal Gupta, S/o Tunda Mal of Bikram Chowk Jammu, Narinder Kumar Jain S/o Charanjeet Jain of 3 Jain Colony Talab Tiloo, Jammu, Ashok Kumar Sharma, S/o Girdhari Lal Sharma  of Paloura Janipur, Nasir Hussian, S/o Bashir Hussain of Paloura, Varun Manhas S/o Satish Mahajan of 24 Malhotra Street Jammu and Rajinder Singh Katoch S/o Mast Ram of Resham Ghar Colony.
The CB has registered a case FIR No 37/2013 U/S 419, 420, 423, 465, 466, 467, 468, 471, 120 BC RPC against them.
The FIR was lodged by the  Crime Branch on the basis of a complaint by Sukhvir Kohli alleging that two persons namely Mohinder Pal Gupta and Sham Singh offered to sell a plot of land to him belonging to Sham Singh measuring two kanals under Khasra No 164 situated at Chak Changerwan tehsil and district Jammu for Rs 30 lakh. Mr Kohli made payment of Rs 30 lakh through Mohinder Pal Gupta to Sham Singh. An irrevocable General Power of Attorney was registered before the Ld Sub Registrar IV (2nd Additional Munsiff), Jammu. After waiting for a considerable time and despite repeated request neither the sale deed was executed nor possession of land handed over, the Kohli said in his complaint.
The Crime Branch started inquiry and it was found that accused Varun Mahajan who was well known to the complainant introduced Mohinder Pal Gupta and Narinder Kumar Jain with the complainant with the offer of a plot under Khasra number 743 min situated at Lower Muthi in Jammu district. This was accepted by the complainant for a sale consideration of Rs 8.90 lakh and in this regard Mohinder Pal executed an agreement to sell after receiving an advanced payment of Rs 3.50 lakh in presence of Varun  Mahajan. Despite repeated requests the possession of this plot was not handed over to complainant. Mohinder Pal and Varun Mahajan again approached him and allured him through a power of attorney on November 11, 2006 executed between Sham Singh and Narinder Kumar Jain pertaining to land measuring two kanals under Khasra No 164 at Chak Changerwan and succeeded in entering into a deal of Rs 30 lakh which was accepted by the complainant who paid the total amount as sale consideration. After receiving the amount Mohinder Paul executed an agreement to sell after obtaining the entire amount of consideration and also executed an irrevocable General Power of Attorney. But Mohinder Pal was not empowered to execute these documents. The CB in its investigations also found that the power of Attorney executed by Sham Singh the original owner of land in favour of Narinder Kumar Jain was also revoked by a deed of revocation duly registered before Sub Registrar Jammu. Besides one Rajinder Singh Katoch of Resham Garh had impersonated as Sham Singh in the court at the time of registration of the document executed by accused Mohinder Pal Gupta.
