Consider claim of 3 docs for regularization: HC

JAMMU, July 14: First Puisine Judge of J&K High Court, Justice Ramalingam Sudhakar today directed the Health Department to consider the claim of Dr Ramesh Gupta, Dr Harbans Lal Sharma and Dr Ravinder Rattanpal for regularization of their services as Deputy Medical Superintendent  in the Medical Education Department on the analogy of Dr Jasbir Singh and Dr Rakesh Khajuria with effect from the date they have been appointed as Deputy Medical Superintendents.
After hearing both the sides, Justice Sudhakar observed, “if the petitioners are entitled for regularization in the Health Department and are to be promoted as Chief Medical Officers first, their cases should be considered at the threshold”, adding “thereafter the question of deputation can be addressed”.
“The petitioners are neither here nor there and this anomaly should be removed by the Government”, the Justice Sudhakar said, adding “the court is inclined to set aside the impugned order on account of vagueness and bereft of proper details as to why the claim has not been considered”.
“If petitioners are entitled to regularization in the parent department and thereafter, designation as Chief Medical Officers based on their eligibility that benefit should be given. This will be as per the advisory of the GAD”, High Court said.
The High Court directed the official respondents to consider the claim of the petitioners for regularization, if they satisfy the eligibility criteria as per relevant rules. “Thereafter, the department will consider promotion to the post of Chief Medical Officers as per rules as may be applicable. The petitioners, can thereafter be considered for appropriate post either Medical Superintendents or other post in the Medical Education Department, as per their seniority and eligibility”, Justice Sudhakar said.
With these observations, court disposed off the petition.
