Court awards 4 yrs imprisonment to thief

JAMMU, Sept 12: Judicial Magistrate Mahanpur Sandeep Gandotra today awarded four years imprisonment to Surjeet Singh  for broad day theft and one year to his associate Mohan Lal.
According to the police case, on May 2, 2008 Ram Singh, son of Duni Chand of Basohli presented a written complaint against the accused Surjit Singh alias Pinku  with endorsement made by SDPO Basohli for registration of case under law.
In the complaint, it was stated that on April 6, 2008, Surjit Singh came to his house and stole Rs 7900 cash, one gold ornament weighing 8 Masa, two necklaces (one weighing 32 grams and other weighing 22 gms) from his house.
When the accused committed theft, the wife of the complainant was at Mahanpur in connection with shopping and his son was also not at home. On April 6, 2008 when wife of the complainant came back she found lock of iron box opened in which complainant had put his money and gold ornaments.
On the receipt of this complaint, FIR No. 47/08 for offences under Section 454/380 RPC was registered and after completion of investigation challan was presented in the court of law.
After hearing both the sides, Judicial Magistrate Mahanpur observed, “the prosecution has succeeded in proving its case against the accused persons beyond all reasonable doubts. The prosecution has proved it by cogent and reliable evidence that accused Surjit Singh had committed theft of gold ornaments in the house of complainant. As such, accused Surjit Singh was convicted and awarded simple imprisonment for a period of two years. He was also convicted for offense under Section 380 RPC and was sentenced to undergo further simple imprisonment for a period of two years.
Another accused Mohan Lal, son of Sudesh Kumar of Mahanpur was also convicted for offence under Section 411 RPC and awarded simple imprisonment for a period of one year.
