JAMMU, May 11: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today awarded rigorous life-imprisonment and fine of Rs 10,000 to a man for murdering his wife.
According to the prosecution case, accused persons—Javed Ahmad and his mother Suriya Begum strangulated Parveen Begum on June 28, 1998 at their residence at Haveli Mohalla Bhaderwah and later set the body ablaze in order to destroy the evidence of murder.
After hearing Public Prosecutor Shabir Choudhary for the State whereas Senior Advocate Sunil Sethi for the accused, Principal Sessions Judge observed, “this case speaks of the story of despicable betrayal of connubial trust by a husband against his wife. The lust of a husband to get rid of his wife has put a wedge in their marital relationship and unfaithfulness towards her put an end to the blooming life of the unfortunate and young pregnant woman”.
“The deceased’s yearning to have long and happy marital life was exterminated. The husband and mother-in-law of deceased allegedly displayed a drama in their home on the fateful day that the deceased has committed suicide by pouring kerosene oil on her”, the Court said.
While referring to a case of Supreme Court titled Himachal Pradesh Vs Manchar Singh Thakur, the Court observed, “the taking away of life by unnatural means has been prohibited since time immemorial howsoever a person strong may be”, adding “I agree with the pleas raised by defence counsel that the accused is young man and is only bread earner of the family. He has no previous record of crime also. He is neither a terror to the society nor menace therein”.
“The counsel finally has prayed that the case does not fall within the category of rarest of rare case which calls for imposition of capital punishment on the accused/convict. In view of the guidelines issued by Apex Court, this case does not fall under the category of rarest of rare case”, the Principal Sessions Judge further observed.
With these observations, the Court awarded rigorous imprisonment for life and a fine of Rs 10,000 to the accused.
