Court denies bail to accused facing trial in kidnapping, rape case

JAMMU, Apr 26: Principal Sessions Judge Kathua, Vinod Chatterji Koul today rejected the bail application of Yog Raj, son of Pritam Chand of Kathua, who was facing trial in kidnapping and rape case.
According to the police case, on March 2, 2013, the accused kidnapped the minor prosecutrix and raped her. During the course of investigation, the accused was apprehended and the prosecutrix recovered from his possession. Accordingly, police recorded the statement of the prosecutrix and the witness and on conclusion of the investigation challan was presented in the court of law.
After hearing Advocate C L Rasotra for the accused person whereas Public Prosecutor Ravi Kumar Gupta for the State, Principal Sessions Judge Kathua Vinod Chatterji Koul observed, “it must be kept in mind that rape is a social offence and a rapist cannot claim bail for the reason that his liberty cannot be curtailed”.
“In the context of Indian culture, a woman – victim of sexual aggression – would rather suffer silently than to falsely implicate somebody. Any statement of rape is an extremely humiliating experience for a woman and until she is a victim of sex crime, she would not blame anyone but the real culprit”, Principal Sessions Judge said, adding “while appreciating the evidence of the prosecutrix, the courts must always keep in mind that no self-respecting woman would put her honour at stake by falsely alleging commission of rape on her”.
“There is nothing on record that creates any doubt/disbelief or a suspicion about the evidence of the prosecutrix”, the court said while rejecting the bail application of the accused.
