JAMMU, July 9: In an execution petition seeking execution of award passed under Payment of Wages Act in favour of 93 petitioners in case titled “Shamas Din & Ors Vs. National Garage, Gangyal & B.C. Road, Rehari, Jammu & ors” wherein petitioners sought execution of the award for an amount of more than Rs 1.18 cr, the court of Chief Judicial Magistrate, Jammu issued show cause notices to National Garage, Gangyal and B.C Road, Rehari Jammu through its proprietor Chander Kishore Gulati and other respondents namely Shailender Gulati and Sandeep Gulati as to why on account of their failure to satisfy award in question, they be not sent to civil prison in-consonance with provision of Code of Civil Procedure.
Earlier also, an attachment warrant was issued in the name of District Collector (Deputy Commissioner), Jammu to attach the property of National Garage, the trade name of M/S C.L Gulati & Sons Ltd. to the tune of amount awarded.
Petitioners have earned the award under execution in the capacity of the employees of the National Garage in question and after said warrant could not be executed fruitfully, court issued the show cause notices.
