JAMMU, June 8: Principal Sessions Judge Udhampur, R S Jain today rejected the bail application of Suresh Kumar, Sunil Kumar and Pawan Kumar, sons of Nek Ram and Pawan Kumar, son of Des Raj, who were allegedly involved in ATM theft case.
After hearing both the sides, the court observed, “if serious economic offence is alleged to be committed by the applicant/ accused which adversely affects the public and society at large, then discretion cannot be exercised”.
“If such offences are viewed lightly, then the confidence of the public in the institution of justice would be shaken”, the court further said, adding “mere sending of the accused to judicial custody cannot be taken as a ground to be enlarged on bail as a matter of right, more so, when the investigation is still under process and major part of the misappropriated amount is yet to be recovered”.
With these observations, court rejected the bail application of accused.
