SRINAGAR, Oct 1: A local court today rejected the bail plea of an alleged drug peddler who was arrested by the police along with a large consignment of illegal drugs.
After hearing the arguments of both the sides, the Court of 4th Additional District & Sessions Judge Srinagar ordered that given the quantity of contraband items recovered and the investigation still being under process, it cannot consider granting accused bail.
“Having regard to the nature of the offences committed, quantity of contraband items recovered and the stage of investigation, which is still under progress this court at this stage is not satisfied that there are reasonable grounds for believing that the accused/petitioner is not guilty of such offence, as such accused/petitioner does not deserve concession of bail at this stage,” the court stated. In such heinous offences, the court added, bail cannot be claimed as a matter of right.
“No case of exceptional mitigating circumstances is made out for exercising discretion of bail in favour of petitioner. Application is thus rejected. Application stands disposed of accordingly and be consigned to records,” the court ordered.
The recoveries that were made from the accused when he was arrested include: two boxes which contained 100 ml bottles contains Chlorpheniramine maleates, Cough Syrup Welcoyrex, 238 bottles Codeine Phosphate syrup, and 120 strips of Spasmoproxyvon tablets (24 tablets in each strip, total 2880 tablets) and 68 strips of Alprozolamn tablets (60 tablets in each strip, total 4080 tablets).
