SRINAGAR, July 18: A local court today restrained JKCA from conducting election till next date of hearing.
The direction has been passed in a suit filed by United Cricket Club (UCC) in the Court of Principal District Judge Srinagar, which transferred the same to the Court of Munsiff/ Sub Registrar, Srinagar.
UCC is a registered Club with the JKCA and is having every right to participate in its working, management and administration including the election of the Association.
“The constitution of the JKCA lays down that the election is to be conducted at headquarters, which is situated at Srinagar after issuing proper notification in this regard. But surprisingly, the JKCA in complete violation of the norms without issuing any notification for election is going to conduct the election on July 19 (tomorrow) at Jammu, which is not the headquarter of the JKCA and the election is malefidely conducted at a time when the Valley is under constant restrictions of curfew disabling the affiliated clubs to move out to reach the venue and participate in the election”, UCC said in the suit.
After going through the suit, Munsiff/Sub Registrar Srinagar Fayaz Ahmed Qureshi observed “Prime facie it appears that the applicant has qualified the tests for grants of interim injunction. Considering the urgency projected and involved in the matter, issuance of prior notice is dispensed with”.
Accordingly, Court issued notice to otherside for filing of objections if any to the instant application. In the meantime, JKCA has been restrained from conducting election till next date of hearing, which is fixed on July 25.
