JAMMU, June 10: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur today directed Chairman of Services Selection Recruitment Board to pay compensation of Rs 30,000 to the petitioner for delaying implementation of court order for three years.
When the contempt petition was taken-up, Division Bench observed, “the contempt petition has been filed by Jagdeep Kour against non-compliance of the directions dated 17.05.2012 issued in LPA wherein this court while dismissing the appeal filed by the Services Selection Recruitment Board had directed for implementation of the judgment of the Writ Court within a period of eight weeks”.
The Writ Court had directed the State respondents to consider the case of the petitioner for appointment as Physical Education Teachers. When the matter was listed on 05.05.2015 counsel appearing for the Board extended assurance that the court order will be complied within four weeks and on this assurance the matter was deferred and it was directed that in default, Chairman SSRB will appear in person.
After hearing Advocate Anil Sethi for the petitioner whereas Advocate Liaqat Ali appearing for the SSRB, DB observed, “neither compliance of the direction is reported nor Chairman SSRB is present in the court”, adding “the counsel appearing for the Board seeks further time to comply with the directions”.
After considering the submissions of both the sides, Division Bench granted two weeks time to report compliance and for the delay in implementing the order of the court for the last over three years directed Chairman SSRB to pay compensation of Rs 10,000 for each year totaling an amount of Rs 30,000.
