JAMMU, Feb 29: In a Public Interest Litigation filed by Atul Gupta, Division Bench of State High Court comprising Chief Justice N Paul Vasantakumar and Justice B L Bhat today issued direction to the revenue authorities to take decision with respect to the issuance of permanent resident certificates within a period of three months.
When the matter came up for hearing, Advocate Aditya Sharma pleaded before the DB that the direction be given to revenue authority to simplify the procedure for getting the permanent resident certificate by adhering to Clause-i of Sub Rule 3 of Section 3 of Jammu & Kashmir Grant of Permanent Resident Certificate (Procedural Rules) 1968 and issue the PRCs to those whose father/grandfather are the permanent residents and are residing in the State.
He further argued that revenue authorities shall not insist upon the applicants who were applying for the PRCs to produce the record of 1944 and the voter list of 1951 as the same are irrelevant and do not serve any purpose. He further pleaded whosoever applied for the issuance of PRCs have been put to face harassment on one pretext or the other by asking them to produce the records of last six seven decades.
After hearing Advocate Aditya Sharma, DB disposed of the PIL with the direction to the revenue authorities to take decision with respect to the representation of the petitioner within a period of three months.
