JAMMU, Oct 15: Division Bench of State High Court comprising Justice Virender Singh and Justice Bansi Lal Bhat today directed Commissioner Jammu Municipal Corporation to perform statutory obligations in terms of J&K Control of Building Operation Act and take action against those operating commercial activities in residential houses in Gandhi Nagar area.
The direction was passed in a petition filed by the residents of Block A, Sector C Gandhi Nagar. They submitted that private respondents namely Arun Bakshi and Suresh Bhawani, Chairman/MD Jet King have opened six offices in a residential house No 17 A/C Gandhi Nagar under the name and style of NG Properties, Steeping Fashions, Placement Overseas, Xclusive Beauty Parlour, Ami Soft Academy and Sakun Educational Consultants.
“Such offices have been opened in the residential house without there being any permission from concerned authority (Jammu Municipal Corporation), as such are in violation of Master Plan”, the petitioners submitted.
During the course of arguments, Advocate Parag Sharma appearing for the petitioners submitted, “it appears that private respondents are hand-in-glove with the concerned authority (JMC Commissioner) otherwise by now they would have been served with the requisite notices under J&K Control of Building Operation Act”, adding “this court has already taken a serious note of violations of Master Plan being carried out within the limits of Municipal Corporation Jammu”.
After hearing Advocate Parag Sharma in length, DB observed, “it is once again a wake-up call for Commissioner Jammu Municipal Corporation to perform statutory obligations in terms of J&K Control of Building Operation Act”, adding “in case private respondents are running commercial activities in a residential house without there being any permission or in violation of Master Plan, JMC Commissioner would take appropriate action against them in accordance with law and furnish report in this regard before the next date of hearing”.
